Kabaziguruka seeks to trial before General court martial

Jailed Nakawa Division Member of Parliament Micheal Kabaziguruka petitions the High court in Kampala seeking for orders halting his trial before the Makindye General Court Martial.

Through Rwakafuuzi and company advocates,  Kabaziguruka is challenging his trial on grounds that his right to a fair hearing will be curtailed since the Army court is not legally mandated to try civillians.

Kabaziguruka also questions the impartiality of the Army court saying it is not independent but rather subject to direction and control from President Museveni.

He therefore wants the High court’s Civil Division, to stop his trial  in the Army court where he is facing Treachery  and  offences relating to security.

Last month Kabaziguruka was arraigned before the Army court together with 22 other people including UPDF soldiers, but he refused to plead to the said charges and he was remanded to Kigo Government Prison until tomorrow12th.July.2016.

He maintains he is not subject to military law.

However Prosecution at the Army court alleges that the 23 contrived a plot  to overthrow the government of Uganda by force of arms, in Districts of Kampala, Wakiso and Luweero between February and June this year.
