Hearing of slain muslim cleric case flops

Hearing of the Slain Muslim Cleric case flops at the International Crimes Division of the High court in Kampala for the second time, after DPP chose another Prosecutor Lino Anguzu to take over the trial from Richard Kamuli.

However no reason was given for the change, thus Anguzu was not ready to proceed and applied for more time to study the case file given to him last week.

Anguzu is one of those prosecutors who handled the concluded Kampala twin bomb case.

Anguzu has also admitted before court that prosecution has never disclosed its evidence against the 32accused persons to the defence team, which he also asked court to allow them, do by Friday this week.

Defence lawyers led by Rwakafuuzi Ladislaus and Fred Muwema on the other hand asked the panel of 3judges led by Ezekiel Muhanguzi to give the state the last adjournment, and if the case doesn’t proceed next time,  the accused persons be granted bail.

The defence team also wants the court to first determine wether it has jurisdiction to try the accused persons on terrorism and murder charges that are not part of the supposed to be tried under the ICC Rome Statute.

According to Muwema its genocide and crimes against humanity charges that are listed under the Rome statute, but the judges advised them to first wait for the rules governing this trial to be published then they can formally be heard on this preliminary objection.

The matter has now been adjourned to 9/August/2016.
