Court nullifies election of FDC’s Kantinti

The High court in Kampala nullifies the Election of FDC’s Apollo Kantinti as MP representing  Kyadondo East constituency  due to Electoral Commission’s non-compliance with several electoral rules  governing the Parliamentary Elections Act.

This after presiding Judge, Isabirye Kaweesa found Wakiso district returning officer Sarah Bukirwa guilty of disenfranchising voters and failure to ensure safe custody of election materials, where by DR forms from 7 polling stations in the constituency disappeared.

Justice Kaweesa also faulted Bukirwa for failing to file a police report in relation to the said mess whose results she unfairly cancelled.

The Judge further expressed concern about the quality of work done by presiding officers in Kyadondo constituency, citing a one Sempebwa Kato, the presiding officer of Manyangwa TC polling station who confessed on oath to have signed DR forms before the commencement of the voting exercise.

He therefore ruled that in such circumstances it was very difficult to ascertain the winning margin between contenders of the election, where Kantinti was declared winner with 9005 votes while Sitenda Ssebalu the second runner up polled 8679 votes.

The judge then declared Kantinti’seat vacant and ordered for fresh election in the constituency.

The Electoral Commission and Wakiso District returning officer Bukirwa Sarah have also been ordered to pay costs of this petition to Sitenda Ssebalu.

NRM’s William Sitenda Sebalu sued Kantinti , the Electoral Commission and Wakiso district returning officer Sarah Bukirwa for conniving to commit several irregularities which affected the quality of the election in Kyadondo East, in a substantial manner.  This brings to 13 the number of MPs whose election has been nullified by court.
